GENERAL CONDITIONS OF CONTRACT

This contractual document will govern the contracting of products and services through the website www.emunaimeraki.com, property of Anna Maria Paradeda Bosch, provided with NIF number 43675342K, with address at C/ Migdia 90-92, 17003, Girona and with email info@emunaimeraki.com. (from here on, the PROVIDER).

Accepting this document means that the user:

2. It is a person with sufficient capabilities to carry out the contract.
3. Assume all obligations herein.

OBJECT OF THE CONTRACT

The objective of the contract herein is the contractual regulation of sales between the USER and the PROVIDER.

1- GENERAL CONTRACTING CLAUSES

Unless specifically provided in writing, placing an order with the "PROVIDER" will imply acceptance by the "USER" of these legal conditions.

No conditions made by the "USER" may differ from those of the "PROVIDER" unless it has been expressly accepted in advance and in writing by the "PROVIDER".

The present conditions, together with the Privacy Policy and the Legal Notice of the Website, are the only conditions that will apply to the use of the Website and the purchase of products through it and will replace any other conditions.

Consequently, the "USER" who accesses the Website and purchases products through the Website is subject to and fully bound by these Conditions, the Privacy Policy and Legal Notice in its current form. are written at the time of access to the Website.

2- SHIPPING OF ORDERS

Shipments on www.emunaimeraki.com are made through a courier service (Post Office)

Shipping costs include "Value Added Tax" VAT in all cases, but do not include any other taxes, for example, taxes, customs, duties or surcharges.

The "PROVIDER" will deliver the orders to the courier service (Post Office) within a maximum period of 48 business hours. Likewise, the "PROVIDER" will not be responsible for any possible delivery delays caused by the courier service.

The "PROVIDER" will not send any order until it has checked and verified that payment has been made by the "Buyer"

Delivery times for shipments to Spain (Peninsula) take approximately 1 to 2 business days (Monday-Friday) as long as payment has been verified by the "USER".

Delivery times for shipments to Spain (Balearic Islands, Canary Islands, Ceuta and Melilla) will take approximately 2 to 5 business days (Monday-Friday) as long as payment has been verified by the "USER".

Delivery times for shipments to Portugal will take approximately 2 to 3 business days (Monday-Friday) as long as payment has been verified by the "USER".

Delivery times for shipments to Andorra will take 2 to 3 business days (Monday-Friday) as long as payment has been verified by the "USER".

Once we deliver the package to the courier service, the "USER" will receive an SMS or Email with the shipment tracking number. The "PROVIDER" will not assume any responsibility when the delivery of the product is not completed as a result of the data provided by the "USER" being false, inaccurate or incomplete. In all these cases, the "PROVIDER" will only refund the price of the products purchased without assuming the corresponding shipping and return costs.

In the event that the "USER" decides to return the products voluntarily without defects or irregularities in them, only the amount corresponding to the products will be refunded to the customer less shipping and return costs.

The delivery will be considered completed at the time the courier service carrier makes the corresponding products available to the "USER" and the latter, or any delegate thereof, has signed the corresponding document at the time of receipt of the delivery.

3. RIGHT OF WITHDRAWAL

The "USER" will have a maximum period of fifteen business days to withdraw, from the day of receipt of the product, without any type of penalty and without the need to indicate the pertinent reason.

Unless the return is made due to defects in the purchased product, the "PROVIDER" will only reimburse the "USER" the amount corresponding to the returned product, minus the corresponding shipping and return costs. In all cases, the returned product must be wrapped in its original packaging and in perfect condition.

The "PROVIDER" will have the option not to apply the right of withdrawal in the following cases:

1. If the product is not presented in optimal conditions.
2. If the product packaging is not the original or it is not in perfect condition.
3. If the product is opened and it cannot be demonstrated that it has not been used prior to the return.
4. When they are personalized or handmade products.

The "USER" will not have the option to cancel the order if it has already been confirmed.

4. RIGHT TO NOT ACCEPT AN ORDER

The "PROVIDER" may cancel at any time an order that has already been confirmed or will have the right not to accept an order placed in the following cases:

1. In the case of a computer, technical or writing error in the prices or in all of the product data stored on the Website at the time of placing the order.
2. When web security systems give us indications that the order may be fraudulent.
3. Due to lack of stock
4. When the "PROVIDER" cannot deliver the order to the address indicated by the client.

6- FORCE MAJEURE

In the event that the "USER" places an order for one or more product(s) and it is not available due to circumstances of force majeure, the "PROVIDER" would contact the "USER" via email or telephone informing him of the Full cancellation of the order.

The "PROVIDER" is not responsible for possible delays in deliveries or the impossibility of making them, when it is as a result of force majeure that is not under our control, as in the following cases:

• Accidents
• Strikes
• Terrorist threats or attacks
• Fires or explosions
• Meteorological causes (Storm)
• Natural disasters (flood, collapse, earthquake, epidemic)
• Problems in telecommunications systems
• Problems in transportation

The "PROVIDER" once the cause(s) that caused impossibility or possible delays has been completed, will do everything possible to restore its commercial activity and thus be able to comply to the extent possible with its shipments and obligations.

7- TRANSFER OF DATA

12- GUARANTEES APPLICABLE BY THE PROVIDER

13- RETURNS

To make a return or size change, the "USER" will have a period of 15 business days from receipt of the product.

In all cases, the returned product(s) must be in perfect condition, unused and in its original packaging. To avoid problems in transportation, the product must be sent by certified mail, you must send us the return tracking number to our email info@emunaimeraki.com to have the shipment located, in addition to ensuring that the package is properly protected and sealed. 14 - JURISDICTION

Emuna & Meraki reserves the right to file civil or criminal actions that it deems appropriate for improper use of its website and content or for non-compliance with these conditions.

In the event that any controversy arises, the parties may submit their conflicts to arbitration or go to ordinary jurisdiction, complying with the rules on jurisdiction and competence in this regard. Products with a discount on their original price

Products with a discount on their original price are all products purchased with discount codes, with a catalog discount on their original price during the time period indicated above.

Changes

For these products, only one exchange will be allowed for another size (larger or smaller without distinction) of the same product purchased or a different product, and it is not possible to make more than one exchange for the same product.
